Yes. As most news articles mention, Swartz bypassed a number of (admittedly trivial) restrictions set in place by JSTOR and MIT.

I was actually thinking of something along the lines of an email to somebody about the situation, seems like something that would avoid a lot of trouble if the stated view were true. That said, having seen his relevant manifesto now I realize it's not a particularly legitimate view.
